1. Who we are

Kini sells grocery and household care hampers for delivery within South Africa, so that people can provide for a parent or relative they do not live near.

Throughout these terms, “Kini”, “we” and “us” mean Kini and its authorised staff. “You” means the person placing the order. “Recipient” means the person the hamper is delivered to. Written queries go to [email protected].

2. Accepting these terms

By browsing this website, adding a hamper to your cart or completing an order, you confirm that you are at least 18 years old, that you have the legal capacity to enter into a contract, and that the information you give us is accurate.

We may update these terms from time to time. The version published on the day you place an order is the version that governs that order.

3. Products and availability

The contents of each hamper are listed in full on the hampers page. Quantities are fixed; the hampers cannot be customised.

Brands may vary by region and by supplier availability. Where a listed item is unavailable, we substitute an item of the same type and at least the same quantity and quality, at no extra cost. The delivery note records exactly what was packed.

Product images and descriptions are illustrative. Packaging may differ from what is shown.

4. Prices

All prices are in South African rand. Delivery is calculated at checkout from the delivery address and shown to you before you pay.

We may change prices at any time, but never after an order has been confirmed. If a price is displayed incorrectly due to an obvious error, we will contact you before processing the order and you may confirm it at the correct price or cancel it for a full refund.

5. Placing an order

Adding a hamper to your cart is not an order. An order is placed when you complete checkout and payment, and a contract between us comes into effect when we send you an order confirmation by email.

An order ships to a single delivery address. If you are sending hampers to more than one recipient, place a separate order for each address.

We may decline or cancel an order where payment cannot be verified, where the delivery address falls outside our delivery area, where stock is unavailable, or where we reasonably suspect fraud. If we do, we refund you in full.

6. Payment

Payment is by card or instant EFT through our payment provider. Card details are entered on the provider's secure page; we never see or store them.

International cards are accepted, so family living abroad can place and pay for an order themselves. Your bank may apply its own conversion or cross-border fees, which are outside our control.

Orders are only packed once payment has cleared.

7. Delivery

We deliver to all nine provinces of South Africa. Hampers are dispatched within 2–4 working days of a confirmed order, and you receive an email when the hamper leaves us.

Delivery timeframes are estimates, not guarantees. Load shedding, courier delays, weather and public holidays can extend them, and we will tell you if we know of a delay.

You are responsible for giving a complete delivery address and a contact number the courier can reach. Where a delivery fails because those details were incorrect or nobody could be reached, a further delivery charge may apply to the next attempt. Use the order notes field at checkout for gate codes, landmarks or the best time to deliver.

Risk in the goods passes to you on delivery to the address on the order.

8. Changes & Refunds

Tell us as soon as possible if something needs to change. If the hamper has not yet been packed and dispatched we can change the delivery address, swap the hamper or cancel and refund it in full.

Your rights once a hamper has arrived, including damaged goods, missing items and cooling-off cancellations, are set out in the returns and refunds policy, which forms part of these terms.

9. Sending to someone else

Most Kini orders are delivered to a third party. When you give us a recipient's name, address and contact number, you confirm that you are entitled to share those details with us for the purpose of delivering to them.

The recipient is not a party to this contract. All correspondence, receipts and refunds go to you as the person who placed and paid for the order.

10. Splitting the cost

The share calculator on this website is a planning tool. It does not collect, hold or transfer money, and it does not create any obligation between you and the people you plan to share the cost with.

Whoever completes checkout is our customer for the purposes of these terms, regardless of who contributed. Arrangements between family members are a matter between them.

Shared funding inside the Kini app is in development and will be governed by its own terms when it launches.

11. Accounts

You may check out as a guest or create an account. An account stores your delivery addresses and order history so that repeat orders are quicker.

Keep your password confidential; you are responsible for activity on your account. Tell us immediately if you believe it has been used without your permission. You may ask us to close your account at any time.

12. Using this website

The text, layout, graphics and the Kini name and logo on this site belong to us and may not be copied or reused without our written permission.

You agree not to interfere with the site, attempt to access it other than through the interface we provide, or use it for any unlawful purpose. We aim to keep the site available but do not guarantee uninterrupted access.

13. Liability

We take reasonable care in sourcing, packing and dispatching every hamper. Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 or excludes liability we cannot lawfully exclude.

Beyond that, our liability arising from an order is limited to the value of that order, and we are not liable for indirect or consequential loss.

Hampers contain ordinary retail groceries and are not a substitute for medical, nutritional or care advice. Check the packaging for allergens and dietary information.

14. Privacy

How we collect, use and protect personal information, including a recipient's details, is set out in the privacy policy, which forms part of these terms.

15. Complaints and disputes

If something has gone wrong, write to [email protected] and we will respond within one working day and work with you to resolve it.

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. Nothing here prevents you from approaching the National Consumer Commission or a recognised ombud.

16. General

If any provision of these terms is found unenforceable, the rest remain in force. Our failure to enforce a term is not a waiver of it. These terms, together with the privacy and returns policies, are the whole agreement between us in respect of your order.
